I have no doubt that the dealership lied to you and mislead you into
entering the lease but unfortunately there is not much that can be done
without risking a lot. In a scenario such as yours they have the defense
based on the fact that it was all written out in the lease agreement.
Beyond that anything they misconstrued during the sale has not recorded -
your conversation with the sales person is difficult to prove and they will
certainly refuse to admit how they mislead you. Certainly there is a
possibility of getting justice by suing them but what are the odds? And
would it be wise to spend $10-$30k to litigate a matter without factual
evidence? Unfortunately you are better off moving on by buying the vehicle
or turning in the lease. Another attorney might recommend otherwise so do
ask around but in the end of the day you just got a bad deal.

I traded a Dodge Caravan in, and leased a 2006 Hummer on my 40 Birthday. The dealer told me that if i put $20,000 down out of my home equity, that the $20k would be available at the end of the lease to transfer to a new lease or be calculated into the purchase of the vehicle at the future market rate.
Now that the lease is due, they are telling me that the $480 a month i paid for 3 years plus the $20k all goes for not and i have to turn the vehicle in or refinance it to own for $33k which totals about $71k all together. If i turn the vehicle in and walk. They get $38k from me, and still turn around sell the vehicle for $20-30k. The vehicle is in excellent condition with only 18k miles on it. This seems to me to be fraud, i can not understand all of the contract language to see where, but it seems that many things were not done in good faith. There is no way i would have put $20k down out of my home value on a vehicle lease with no return on investment. the dealer lied to me.

I am currently going through this situation at the moment. I traded in my vehicle on August 4,2008. The dealorship where i traded in my vehicle is giving me a run around and not paying off my prior vehicle. I need support on resolving this issue ASAP.

Thank you,
Lee

There is an implied warranty with every sale which is in effect even if you sign an "as-is" waiver. Furthermore, if the dealership committed fraud during the sale then they are definitely liable. If you give me a call I can run a CarFax and AutoCheck report on the VIN number to see if the history will reveal anything. Often times the history shows issues that the dealership knew and should have disclosed to you. On the other hand, we can assess the damages to the vehicle and compare them to what they reasonably should have known about the vehicle. There are other options but to get started we need to check the vehicle's history and proceed from there. You can reach me at 866.97.Lemon.

Unfortunately I am not allowed to practice law in Canada thus my advise is more generally as a guidance. I do recommend that you call up your local DMV investigations office to file a claim, also try to locate a local attorney to accompany you to court and to see if there are any nuances based on Canada laws.

I purchased a car that defects didn't show up until I drove home. The dealer said that I would have to pump the brakes as I test drove it down a 35mph road that ended in a cul-de-sak. Like a fool, I signed the papers. On the way home I discovered that the rear shocks/struts were so bad that when the car rebounded from bottoming out in a chuck hole, the rear end shifted several inches. At 60 mpg the front end shimmies and shakes. I also learded that the back-up lights and license plate lights were out ( I checked the fuses and bulbs. Appears to be a problem in the wiring harness.). When I finally got the car home my wife went over the paperwork and pointed out that the lot has charged me 25% interest. The car was sold "as is", but I've learned that there is an" implied warrentyof merchantability".

I will be the first to admit that I am not the sharpest tack in the box. I've been all over the intrenet trying to find someone who will help me get some justice. I had to swallow my 'Man Pride' and admit that the dealer was much smarter than me.

Sincerely,
Bob Miller
